Terms of Service

1. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Service.

If you are under the age of majority, you may only use the Service with the permission of a parent or legal guardian.

2. Description of the Service

Wunderphoto provides AI-powered image enhancement and restoration tools, including but not limited to:

• Photo restoration
• Damage repair
• Color restoration
• Face enhancement
• Image upscaling
• AI-powered image editing
• Future AI photo transformation features

We may modify, improve, suspend, or discontinue features at any time.

3. Accounts

You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity occurring under your account.
• Providing accurate registration information.

You agree not to share your account with others.

4. Your content

You retain ownership of every image you upload.

By uploading content, you grant Synaptix LLC a limited, worldwide, non-exclusive, royalty-free license solely to:

• Store your content
• Process your content
• Generate AI outputs
• Deliver results back to you
• Maintain the Service

This license automatically ends once your content is deleted from our systems, except where retention is required by law.

We do not claim ownership of your photos.

We do not use your uploaded images to train our proprietary AI models.

5. AI generated results

Our Service uses artificial intelligence to restore and enhance images.

Because AI-generated outputs are inherently probabilistic:

• Results may vary.
• Restorations may contain inaccuracies or artifacts.
• We cannot guarantee that restored images will perfectly represent historical reality.
• We do not guarantee that every generation will meet your expectations.

You are responsible for reviewing all generated content before using or sharing it.

6. Acceptable use

You agree not to:

• Upload illegal content.
• Upload images you do not own or have permission to use.
• Upload child exploitation material or other unlawful content.
• Infringe copyrights or trademarks.
• Attempt to reverse engineer the Service.
• Circumvent usage limits.
• Abuse our infrastructure.
• Use automated scraping or bots without permission.

Violation of these Terms may result in suspension or permanent termination.

7. Subscriptions and payments

Certain features require payment.

Subscriptions automatically renew unless canceled before the renewal date through the platform where purchased (Apple App Store, Google Play, Stripe, or other payment providers).

Prices may change in the future. Price changes will not affect the current billing period.

8. Credits

Certain features may consume credits.

Unless required by applicable law:

• Used credits are non-refundable.
• Promotional credits have no cash value.
• Credits may expire if clearly disclosed when issued.

A generation that fails is not a used credit. Where a generation cannot be completed, the credits it consumed are returned to your balance automatically.

9. Refunds

Refund eligibility depends on where you purchased the subscription.

For purchases made through Apple or Google, refunds are governed by their respective policies.

For purchases made directly through Wunderphoto, refunds may be granted at our discretion or where required by law.

10. Intellectual property

The Service, including:

• software,
• algorithms,
• AI workflows,
• branding,
• logos,
• website design,
• user interface,

are owned by Synaptix LLC and protected by intellectual property laws.

You may not copy or redistribute any part of the Service without written permission.

11. Availability

We strive to provide reliable service but do not guarantee uninterrupted availability.

We may temporarily suspend the Service for:

• maintenance,
• upgrades,
• security,
• legal compliance,
• infrastructure changes.

12. Third-party providers

The Service may rely on third-party providers for:

• cloud infrastructure,
• AI inference,
• authentication,
• analytics,
• payment processing,
• email delivery.

We are not responsible for outages caused by third-party providers.

13. Disclaimer of warranties

The Service is provided "AS IS" and "AS AVAILABLE."

To the fullest extent permitted by law, Synaptix LLC disclaims all warranties, including:

• merchantability,
• fitness for a particular purpose,
• non-infringement,
• uninterrupted availability,
• accuracy of AI-generated content.

14. Limitation of liability

To the maximum extent permitted by law, Synaptix LLC shall not be liable for:

• indirect damages,
• incidental damages,
• lost profits,
• lost business,
• data loss,
• emotional distress,
• or consequential damages arising from your use of the Service.

Our total liability shall not exceed the amount you paid to us during the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain liability limitations, so portions of this section may not apply.

15. Indemnification

You agree to indemnify and hold harmless Synaptix LLC from claims arising from:

• your uploaded content,
• your misuse of the Service,
• your violation of these Terms,
• your infringement of another person's rights.

16. Termination

We may suspend or terminate your account at any time if you violate these Terms or if necessary to protect the integrity or security of the Service.

You may stop using the Service at any time and delete your account where that functionality is available.

17. Governing law

These Terms shall be governed by the laws applicable to Synaptix LLC, without regard to conflict-of-law principles.

Any disputes shall be resolved in the courts having jurisdiction over Synaptix LLC, except where mandatory consumer protection laws provide otherwise.

18. Changes to these Terms

We may update these Terms from time to time.

If material changes are made, we will update the Effective Date and, where required, provide additional notice.

Continued use of the Service constitutes acceptance of the revised Terms.
